UPDATE: 12/13/2018 Defendant Ezra James pleaded nolo contendere to one count of cruelty to animals felony level 3 penal code 828..12.(2). Adjudication of guilt was withheld. Ezra is now a qualified offender and must give DNA. He was also fingerprinted. He's under supervised probation for 18 months. He must pay $609.92 in fees. He's been declared indigent. You can light a live raccoon in a trap on fire and let it suffer and just get a slap on the wrist. Shameful.

10/11/2018 Case continued at request of defendant. Early resolution scheduled for Dec 13, 2018 at 8:30 am before Judge Rhonda Babb Div 10 at Moore Justice Center.

There will be early resolution. Sounds like he's making a plea deal. I believe he will appear Oct 11 2018 to accept a plea deal. I have no idea what the plea is. I think he will plead guilty to a lesser offense and pay a fine and court costs. They may also sentence him to three years in jail with all time waived if he doesn't commit another crime while on probation for same time. That's just my guess.

The probably cause document has just been unsealed. It's below redacted as a two page pdf. Ezra is listed as retired. It states as follows,

"On August 16, 2018 Ezra Lee James did commit the offense of Animal Cruelty resulting in death by intentionally and willfully capturing a raccoon, pouring gasoline on it and setting it on fire while still in a metal trap. This resulted in the cruel death of the raccoon; when I arrived on scene the raccoon had been pulled out of the cage and was laying on the ground. The raccoon was still alive, completely burned, skin was pulled back from the feet from the burns. I had to put the animal down with my gun to end its suffering."

ORIGINAL: Ezra James trapped a raccoon which he believed was eating his mangoes. He admitted to then pouring gasoline on it lighting it on fire August 15, 2018 at night. He left the raccoon in the trap. The neighbor saw it and called police. Police humanely shot the raccoon to death to put it out of its misery. He was arrested at his home August 16, 2018. He paid bond and was bailed August 17, 2018. James, Ezra booking number 4857028.

Ezra Lee James was born February 12, 1930 in Jamaica. He currently lives in Palm Bay, Brevard County, Florida. He was arrested August 17, 2018 at his home. He was charged with a felony, cruelty to animals in the third degree. There are many other cases against him in Brevard County.

Ezra James was charged with a felony animal cruelty in the third degree. Sentence is no more than five years in jail and/or $10,000 fine. I personally believe Ezra James has some senility and has seriously lost his judgment. He admitted to his crime on video for the media. I think he should be sentenced to counseling, community service, a fine and probation. Jail time for an 88 year old man makes no sense.

In 2006 Ezra James went bankrupt. At the time he owned three homes and three cars which included a Cadillac Fleetwood, Lincoln Towncar and a 15 passenger Ford 350 bus. All homes were in foreclosure. He is listed as a transportation provider for the Port Authority of Florida. In 2006 he was a taxi cab service for E & J Transportation making $771/month and unmarried. He collected social security in the amount of $600/month. His bus was repossessed. He tried to get it back. His creditors fought the stays and discharges. His debts were discharged in 2007.

"Nick Nation, a veterinary pathologist and adjunct professor, and Colleen Cassady St. Clair teamed up to study case 53 files and necropsy results cats killed between 2007 and 2017." They state exactly what I stated below about how coyotes kill, dismember and eat cats. This is science. These are facts.

Scotland Yard took three years to come to the conclusion that dead, mutilated cats were killed by foxes and not a "sick depraved human." Here's the summary.

"London police have announced the conclusion of a three-year investigation into a suspected cat serial killer – who activists believe has killed up to 400 animals since 2014. Police said Thursday the culprit, however, is not a person but the urban fox.

Detectives examined dozens of dead cats believed to have been killed by the Croydon Cat Killer, who became something of a local legend as reports of dismembered, beheaded and mutilated family pets began accumulating starting in 2014 in the south London district of Croydon.

But on Thursday police said that foxes were the culprits for the mutilations, which they said were all carried out on cats who had previously been killed by blunt force trauma. “Scavenging foxes then mutilated body parts – especially heads and tails,” police said."

Read the rest of the article. Again there is a suspect who is a male who drives around. How long will the people in Washington still believe a human is killing cats. It's clearly coyotes. It could also be foxes.

ORIGINAL: There have been many reports over many years about "sick, twisted humans" killing cats in gruesome ways. The owner of the cats and others insist a human must have used a "scalpel" to cut their cat in half or disembowel them with very little blood. Some even swear they saw a "sketchy looking man in a car driving around the neighborhood looking for cats to kill." They swear the body parts were "placed, staged" to cause humans fear. They even offer rewards for the "killer."

Years of evidence has shown that these are generally cases where a coyote or two killed a cat to eat.  Their main diet is wild bunnies, ground squirrels, gophers and berries. If you leave your cat outside and unprotected, they will eat it because it's easier to catch than a wild bunny or gopher. Keep your cat and all small pets indoors and protected.

How to tell if a coyote or a human or a dog killed your cat.

Coyotes try to approach the cat from behind. They don't want to have to deal with sharp teeth and claws. They will grab the cat by the back of the neck and bite, shake hard to quickly kill the cat. Sometimes when they bite and shake the head comes off. They will keep their jaws clenched on the cat until they know it's dead. Sometimes the cats die from shock or suffocation.

Coyotes will generally just eat the protein and calorie rich organ meats. After the cat is dead they rip open the stomach area, disembowel the cat and eat the organs. Sometimes the intestines will be pulled out. Sometimes when eating the organs the cat ends up in two pieces. Sometimes they are hunting in a pack. One coyote may grab part of the cat while another grabs the other end. Sometimes they rip the cat in two ripping off all of part of the tail and maybe even degloving the remaining tail or skinning part of the body in the process.

They generally attack from 11:00 p.m. to 6:00 a.m. when it's dark out. Because no humans are generally around at those hours they will eat the cat on the front lawn or parkway. They aren't "intentionally displaying the dead animal" as some state. Outdoor cats generally hang out in the front of homes. If the coyotes are interrupted while they are eating, they may take the cat parts and go eat elsewhere. If it's a pack of coyotes hunting for a female with pups, they may bring the entire dead cat back to the den. They also sometimes do this to train pups how to hunt and eat. Mom will rip open a cat so her pups can get to the organ meat.

Below is an article from Albuquerque Journal, New Mexico, Aug 1, 1993. It quotes Los Angeles County Animal Control.

"Mason's cat, Weasel, disappeared from the driveway of the couple's Plano home last month." "He found the body" "head and forepaw neatly severed, the heart and other internal organs removed and laid aside." 'Otherwise it was all clean. There was no blood on the cat's coat. The remaining intestines were all gone." "The body, head and paw, and heart seemed placed, Mason thought arranged in a triangle. He notified Plano police." Neighbors frequently see coyotes in the area but "Mason does not think coyotes killed his cat. I wouldn't rule anything out but I don't think so." "It looks like the animals have been surgically taken apart, because coyotes are very skilled predators," says Bob Ballenger, executive assistant of the Los Angeles County Dept of Animal Care and Control. "It's not a chew and a rip-up."

Here's another big scare that turned out to be coyotes. I have redacted the person's name and the name of the group. They were not from the area and not familiar with coyote kills. The coyotes live in the golf courses and leave to go eat outdoor cats for dinner at night.

It is with great sadness that I write you tonight, but I feel I must get the word out. There have been a rash of cat mutilations in the area near Cashio St. and La Cienega in West LA. Ten cats have been
chopped in half or into three pieces and posed in the front yards of neighbors in this area since July. *** has been investigating this horrible violent criminal activity and has some leads but have not caught the perpetrator yet. We have posted $1,000 reward signs for information leading to the
conviction of the killer in the area where the bodies have been found. If anyone would like to help with this investigation please contact me at the *** and I will discuss with you ways that you can assist. By the way, it is always best to keep your cat indoors, but especially if you live in this neighborhood!!!"

If a dog were to kill a cat, they also go for the neck. After the cat is dead they generally don't eat it. They may play with it by tossing it around by the neck or legs. You will see a bit of dog saliva on the neck. Coyotes don't play with their food. They just eat it. Very little saliva on the neck. The main wound is on the neck. The other wounds are just from eating it.

Some wonder why there is very little blood at the kill site. There's a very good reason for that. The coyote breaks the cat's neck quickly. This causes the heart to stop pumping. The coyote finally rips into the stomach area, peritoneal cavity when the heart has stopped. For this reason the blood loss will be minimized.

How to keep your cats, small pets safe from coyotes.

The most important thing to do is keep your cats and small animals indoors and protected. If a coyote doesn't kill your cat, a dog, car, another cat could kill them.

It never makes sense to trap and kill coyotes who eat pets. Every coyote you trap/kill will instantly be replaced by another coyote. You'd also need a permit and trappers charge about $1,000-$1,500 to trap each coyote. Coyotes don't go into Hav-a-Hart traps and snare traps are now illegal in Los Angeles, California. It's illegal to trap and relocate healthy nuisance wildlife in California. You'd have to drive them at least 50 to 100 miles away or they'll just return anyway.

The best thing to do is not lure them to your home. Keep small pets indoors. Don't leave out cat food. Coyotes are omnivores who eat berries and seeds. Remove the bird feeder. Lock up your trash. Pick up dropped fruit. Clear brush where they den.

Also deter and exclude coyotes. Every time you see a coyote scare it away by stomping your feet, yelling at it, making loud noise, charge it, run after it... This is from September 2018 in Florida. It is of course a coyote kill. Part of the spine is missing as are the ribs and organs. The coyote chewed through ribs to get to organs, also ate organs in abdominal cavity. Coyote may have been disturbed while eating and took that portion away from the site. TNR people believe it's a human doing this. No. TNR people are responsible for these cats' deaths. Don't leave cats outside for many reasons.

So many times people think it's evil humans when it's not. There have been some truly embarrassing cases of people even police insisting it's a devil worshiper or someone who practices Santeria killing the cats. In the end people realize it's just coyotes. Only three out of 1,300 dead cat calls to Los Angeles Animal Services were not killed by coyotes. Coyotes eat cats and small pets to survive. They don't do it to be mean to people or pets. If you left a stack of money in the middle of the street and someone took it, don't blame the person who took it. Blame yourself for leaving it there unprotected.

Below are some good articles about this subject. This includes research on what coyotes actually eat. It also includes necropsies done by experienced wildlife veterinarians and other experts. They can DNA test the saliva on the neck and other places on the body. They can check to see if there is any coyote fur under the nails of the cats. Generally there's not as the coyotes kill so quickly from behind. Of the small dogs I've seen who were attacked by coyotes and survived, they only have a neck wound.

It's illegal to drown raccoons, opossums in Florida - Animal Advocates

July 2, 2018 There was a set conibear trap under the chicken pen. Conibear traps snap onto the head or leg of an animal. Most animals will chew off that leg to get out of the trap. That's why these traps are illegal in most areas.

"New information: Law enforcement discovered an illegal steel trap set under a chicken pen at the Ocala school where a teacher had horrifically drowned three animals. The teacher, Dewie Brewton, admitted knowledge of this trap.

Yes, this illegal “conibear” trap was included in the report that went to state attorney, Brad King, along with irrefutable evidence of aggravated cruelty. Still, NO CHARGES were filed in this case. We will not tolerate deliberate cruelty to animals and blatant disregard for Florida’s laws."

May 14, 2018  Florida teacher Dewie Brewton drowned an adult raccoon, a juvenile raccoon and an opossum. He has just resigned.

Drowning raccoons and opossums would be considered animal cruelty in Florida. Title XLVI Crimes, Chapter 828, “Animal Cruelty.”

828.12 (1)  “A person who unnecessarily overloads, overdrives, torments, deprives of necessary sustenance or shelter, or unnecessarily mutilates, or kills any animal, or causes the same to be done, or carries in or upon any vehicle, or otherwise, any animal in a cruel or inhumane manner, commits animal cruelty, a misdemeanor of the first degree, punishable as provided in s. 775.082 or by a fine of not more than $5,000, or both.

(2) A person who intentionally commits an act to any animal, or a person who owns or has the custody or control of any animal and fails to act, which results in the cruel death, or excessive or repeated infliction of unnecessary pain or suffering, or causes the same to be done, commits aggravated animal cruelty, a felony of the third degree, punishable as provided in s. 775.082 or by a fine of not more than $10,000, or both.

(a) A person convicted of a violation of this subsection, where the finder of fact determines that the violation includes the knowing and intentional torture or torment of an animal that injures, mutilates, or kills the animal, shall be ordered to pay a minimum mandatory fine of $2,500 and undergo psychological counseling or complete an anger management treatment program.

(b) A person convicted of a second or subsequent violation of this subsection shall be required to pay a minimum mandatory fine of $5,000 and serve a minimum mandatory period of incarceration of 6 months. In addition, the person shall be released only upon expiration of sentence, is not eligible for parole, control release, or any form of early release, and must serve 100 percent of the court-imposed sentence. Any plea of nolo contendere shall be considered a conviction for purposes of this subsection.

(3) A person who commits multiple acts of animal cruelty or aggravated animal cruelty against an animal may be charged with a separate offense for each such act. A person who commits animal cruelty or aggravated animal cruelty against more than one animal may be charged with a separate offense for each animal such cruelty was committed upon.

We feel that Dewie Brewton committed three acts of intentional aggravated animal cruelty in the third degree. If convicted, the sentence would be six months jail time per act, $10,000 fine per act, psychological counseling and completion of an anger management program. We wrote a letter to the state attorney Brad King who oversees Marion county, Florida where this happened asking for charges to be made. We cc'd the letter to the Fish & Wildlife Commission, the school and the school district.

Baby allegedly attacked by raccoon may have been bitten by rats - Animal Advocates

Allegedly around 11:00 p.m. mother Ashley Rodgers at 2141 North 22nd, Philadelphia, PA left her 4-month-old baby Journi Black alone in a one room apartment for one minute while taking another child to the bathroom a foot away. The baby's father Samuel Black was not present. During that one minute allegedly a raccoon entered the home, bit the baby then left the home. Mother found the baby on the floor. Baby was rushed to Temple and  then to St. Christopher for surgery. Now mother is raising money on gofundme and she wants to sue building owner. This is very suspicious.

We've rehabbed raccoons and rats for many years. These appear to be bite marks from a rat. They are not bite or claw marks from a raccoon. Raccoon bite marks leave a dental impression. A raccoon could have bitten the nose, ears, lips off. Claw marks would be five long deep marks. This was clearly a rat or rats.

I personally believe the mother had been out with some friends. She came home at 11:00 p.m. maybe even later and found her baby with rat bites on her face. Maybe the baby wasn't even bitten at the building but another building. Then she made up the story about a raccoon. It's a one room apartment she rented for $375/mo. True, there shouldn't be rats in the room but she had to have left the baby alone which is against the law. That baby would have been screaming. It would take a rat a while to bite, eat that much of the baby's face.

This research article is about rat bites on humans. It generally happens with babies, disabled or elderly left alone and unsupervised. Rats leave "multiple 3-4 mm long sharply demarcated, slightly curved incisions on face, ears."

Charges filed against three who tortured shark to death - Animal Advocates, Mary Cummins

02/28/19: Michael Menzel in shark dragging pleads guilty to two misdemeanors and gets ten days in jail and probation. Robert Benac awaits trial. Charges dropped against Spencer Heintz. The state dropped the main charge which was dragging the shark behind the boat. They dropped the charge as a shark expert said the shark was dead before they dragged it. 

"Wenzel had been facing another felony count of animal cruelty, but it was reduced to a misdemeanor. He also pleaded guilty to a charge of using an illegal method to catch a shark. A commercial fisherman, his saltwater fishing license was revoked for five years. Along with his jail time, which he can serve on weekends, he was sentenced to 11 months of probation and 100 hours of community service. A prosecutor asked that half those hours be served at an animal shelter or animal abuse facility, but attorneys questioned whether such a center would allow him near animals."

Robert Benac was offered the same plea deal but he refused and case is going to trial.

•Two felony counts of Aggravated Animal Cruelty (Third-degree felony).
•One misdemeanor count of Illegal Method of Take – Shark (Second-degree misdemeanor).
Robert Lee Benac (DOB 04/2/1989) of Bradenton, Florida
•Two felony counts of Aggravated Animal Cruelty (Third-degree felony).
•One misdemeanor count of Illegal Method of Take – Shark (Second-degree misdemeanor).
Spencer Heintz (DOB 10/14/1994) of Palmetto, Florida
•Two felony counts of Aggravated Animal Cruelty (Third-degree felony).

They turned themselves in to authorities and were booked. Wenzel and Heintz bonded out of jail while Benac remains in the Hillsborough County jail.

If convicted, they could each go to jail for up to ten years with $20,000 fines.

Why the USDA does not enforce the Animal Welfare Act regulations? Because they have no enforcement power - Animal Advocates

I'm a licensed wildlife rehabilitator and have a small wildlife sanctuary of unreleasable wildlife. I must have a USDA permit to keep these animals. The USDA inspectors told me they have no regulations on size of enclosures, enrichment, type of food...for raccoons, skunks, opossums or squirrels. They only state they must be "sufficient." That said California Fish & Wildlife does have specific regulations for each animal. Our enclosures, treatment are always superior to these minimum standards.

People have asked why the USDA does not go after people who violate AWA regulations. I asked my USDA inspectors who are all licensed veterinarians the same question. They have pets and love animals. They told me they have no enforcement power. If someone is a repeat violator, they will cancel their USDA permit. That is all they can do. They don't have the power to seize the animals, arrest the people or bring charges. They said if they take away the permit, the person will just operate without one with no oversight at all.

Now the California Department of Fish & Wildlife does have enforcement power in regard to wildlife. They can take away someone's permit. If they continue to operate without it, they've committed multiple felonies. They can seize all the animals, arrest the person and file charges against them.

That said someone should write, propose legislation to give the USDA enforcement power just like the Dept of Fish & Wildlife. All that said even with enforcement power the departments don't have the resources to seize and hold all those animals. They have to keep them as evidence until the case is settled or the owner agrees to give them the animals. These cases are long and drawn out.

The only time I've seen Fish & Wildlife take action is when a non-profit rescue has offered to care for the animals during litigation and agrees to take them if the owner or court allows it. That was the only way Fish & Wildlife went after Tiger Rescue. Fund for Animals took care of the tigers and eventually placed them all after the owner signed them over. This is the reason why Fish & Wildlife won't go after the Waystation who has been in violation for years and years.

The only success I've seen is the HSUS Humane Officers who can enforce animal control, animal cruelty, wildlife, regular police...regulations. They only go after cases where they have the resources to care for the animals. They just don't have the resources to help with all the cases.

Rowdy Girl Rescue loses lawsuits is sanctioned by Judge in Texas

This case is identical to my case except in my case they forged their exhibits and perjured their statements on top of this. Hopefully I will have the same result with my appeal

"A Harris County District Judge has ordered the owners of an Angleton animal sanctuary to pay nearly $29,000 in sanctions for filing a frivolous, harassing lawsuit against critics of the sanctuary who called the operation a "scam" on Facebook.

Renee King-Sonnen and her husband Tommy Sonnen, who run Rowdy Girl, described as a "vegan" farm animal sanctuary, were also ordered to pay nearly $29,000 in defendants' attorneys' fees. The couple had sued the critics in February for $1 million, accusing them conspiring for nearly two years to disparage the sanctuary's reputation.  (Tommy Sonnen is also a sanctuary board member).

The critics — which included former volunteers and donors who questioned the nonprofit sanctuary's finances — raised questions on a Facebook page called The Real Rowdy Girl Revealed.

The defendants, which include Dallas child psychiatrist and former sanctuary donor Sujatha Ramakrishna, successfully sought to have the lawsuit dismissed with prejudice under the Texas anti-SLAPP statute, which is meant to safeguard against meritless defamation lawsuits.

In his lengthy reply, the critics' attorney, Adam Milasincic wrote, "There is no doubt what this lawsuit is designed to achieve — stopping the public debate about Rowdy Girl, and silencing critics who raise questions about Rowdy Gir's less-than-stellar fundraising and animal-welfare records."

A presiding judge agreed, ordering the plaintiffs on July 26 to pay $28,750 in sanctions, noting that "The Court considered lesser sanctions, but determined that [the amount] is necessary to achieve the [anti-SLAPP's] deterrent purpose. The Court concludes that, absent the sanction awarded, there is a material risk that Plaintiffs will continue to bring similarly unsuitable claims in the future."
