Peanut the Squirrel's Owner Sues New York. Major Flaws in their Potential Lawsuit, by Mary Cummins of Animal Advocates

Mark Longo and Daniela Bittner filed their notice of intention to make a claim against the New York State Department of Conservation for the death of Peanut the squirrel and Fred the raccoon. You must file a notice within six months of filing a lawsuit to give state a chance to solve issue. They allege unlawful search and seizure, violation of freedom of speech, and other due process violations.

Longo and Bittner stated the incident was the result of alleged "negligence, carelessness, and recklessness" by the state of NY and its agents. They stated they may have violated due process laws by not revealing to a judge their intention to kill the animals after raiding Longo and Bittner's home.

Another alleged issue is that Longo and Bittner stated Peanut and Fred were "companion animals" under the law and not wild animals. This claim was allegedly never discussed in court before the raid, which was another oversight, in their opinion.

"Peanut and Fred were not euthanized, according to the notice, because they weren't sick. Mark and Daniela say the two animals were "executed." That said, Longo and Daniela say they were acting in good faith by trying to get Wildlife Rehabilitators licenses and other permits before the raid occurred.

They will sue for emotional distress, pain and suffering, violations of their constitutional rights and lost wages since Peanut's online presence supplemented their income."

Longo and Daniela's attorney needs to look at relevant Fish & Wildlife laws. They have major flaws in their notice of intent to file a lawsuit. While I agree that the Department handled the situation poorly at least from a public relations standpoint Longo and Daniela knew they never had the legal right to possess wildlife. They were very irresponsible to be widely publicly exhibiting wildlife to the public online especially in a pet-like manner. I warned them as did others. FYI I never reported them. NY rehabbers reported them.

Turns out they were reported over a year ago by NY licensed wildlife rehabilitators. The Department of Conservation contacted them January 2024 and told them to transfer the animals to a licensed facility. Allegedly Longo stated he released them which was a lie.  Longo admitted he knew he needed a permit but didn't have one. He stated he was in the process of getting an "educational permit." Longo and Daniela knew the laws yet continued to violate them which endangered Peanut and Fred who were killed as a result of the actions of Longo and Daniela.

Wildlife is under the jurisdiction of the state Department of Fish & Wildlife. Wildlife is owned collectively by the state. People cannot legally own wildlife. They can never be pets or companion animals. Longo and Daniela did not have permits to possess wildlife. You must have the permits before you possess wildlife. 

Ill, injured and orphaned wildlife must be turned over to licensed permitted wildlife rehabilitators within 48 hours. Wildlife must be possessed according to the law in specific types, sizes of enclosures. How to get a NY wildlife rehabilitation permit. It's not legal to possess wildlife as "pets" or "companion animals." You cannot display animals to the public with the rehabilitation permit. They never would have been allowed to show the animals in a pet like manner because it encourages illegal and improper behavior. 

It is legal in some states to have an exhibit or sanctuary permit for wildlife. You generally need at least two years experience with a permitted person or facility. NY may not allow it though most states do. You need two years experience to rehab Rabies Vector Species animals such as raccoons in New York. You must be approved before you obtain the wild animal. Wildlife that cannot be released back to nature can legally be euthanized. This is not a pet which can only be euthanized due to medical or behavioral condition. Squirrels and raccoons can be dangerous in captivity. I've rehabbed them for over 20 years and know this personally. I've written articles about ex pet squirrels and raccoons. I no longer take them in to try to wild them up for release to the wild. It's too difficult, time consuming and stressful for the animals and me. 

They never had an exhibit permit so they can't sue for lost earnings. They legally were not allowed to make money off or exhibit the animals even just on internet video. All their pain and suffering was the result of their own actions. If they really cared about the animals, they would have gotten them to safety. They could have then gotten proper permits and maybe taken the animals back. I even warned them about these issues and was attacked just for telling them that this would happen. I'm amazed someone didn't report them sooner. I really hoped this couple would do the right thing after people had warned them.

Below is a press release about the situation from PBA of NYS. Longo was given ten months warning before any action was taken. He lied to state agents about the squirrel. The health department ordered the animals killed about the squirrel bit someone when Longo refused to put the squirrel in a carrier. 


I do believe that the situation was handled poorly. The state should have taken the animals to a wildlife rehabilitation facility until things were handled in a better manner. California learned not to instantly kill stray mountain lions and bears. They relocate even thought it's against their own regulations. When they used to euth they got too much hate mail and threats.

Raccoon roundworms baylisascaris in raccoons in Los Angeles California by Mary Cummins Animal Advocates



Los Angeles County Department of Public Health stated there were two recent rare case of raccoon roundworms in humans i.e. baylisascaris procyonis. The roundworms have been here forever. Just don't touch or eat raccoon feces or raccoons. Don't attract raccoons to your home by not allowing them access to food, water or shelter. Clean any feces with gloves and a bag. Don't let babies crawl on the grass if you've seen raccoons anywhere near your property. We've rescued raccoons over 20 years and have never been infected with the worms or eggs. Just heard it was two people in the southbay. We have a lot of raccoons down there. Problem is people feeding outdoor cats which attract raccoons. I will bet the two people who got roundworms were babies crawling on the lawn. Most of the previous human cases were babies crawling on the ground. Their hands touch tiny bit of fresh raccoon poo then they put their hand in their mouth.

Public Health Investigating a Rare Disease Spread from Animals to Humans - People are reminded to take precautions concerning wildlife

The Los Angeles County Department of Public Health is investigating two human cases of a rare parasitic infection, Baylisascaris procyonis, also known as raccoon roundworm. The two cases were found in the South Bay area of Los Angeles County. In humans, the Baylisascaris parasite can infect the spinal cord, brain and eyes and lead to swelling of the brain and eye disease.

While Baylisascariasis is rare in people and the risk to the general public is low at this time, it is concerning because a large number of raccoons live near people, and the infection rate in raccoons is likely high. The confirmed cases of this rare infection are an important reminder for all in Los Angeles County residents to take precautions to prevent the spread of disease from animals to people, also known as zoonotic disease.

Baylisascaris procyonis is a type of parasite (roundworm) that lives in the intestines of raccoons. It does not make them sick, but their feces (poop) can carry the roundworm’s eggs. People can become infected with Baylisascaris if they eat dirt/soil, water, or material contaminated with infected raccoon feces. Young children, developmentally disabled persons, or persons with pica (an eating disorder in which a person eats things not usually considered food) are at highest risk for infection as they may be more likely to put contaminated fingers, soil, objects, or even animal feces into their mouths by mistake. Baylisascaris infection cannot be transmitted from person to person.

Although rare, dogs and cats can also become infected if they ingest raccoon feces or contaminated materials. Cats infected with this parasite cannot transmit it in their feces, and dogs rarely do. Talk to your veterinarian about maintaining your pets on a deworming medication to prevent and treat any roundworm infections.

Animals can greatly enrich our lives and environment and can even benefit our health. However, 60 percent of infectious diseases in humans originate in animals or involve animals, especially wildlife. Public Health reminds everyone to learn about and practice basic safety precautions to prevent the spread of diseases between animals and people (zoonoses), including diseases transmitted by fleas, ticks and mosquitoes. Pet owners should work closely with their veterinarians to keep their pets healthy, too.

“Our health is closely linked to the health of animals around us,” said Dr. Muntu Davis, MD, MPH, Los Angeles County Health Officer. “Simple precautions, like washing your hands regularly, avoiding direct contact with wild animals and their waste, keeping pets healthy, and preventing wildlife from sheltering or living in or next to our homes or properties can help keep our neighborhoods and families safe and healthy.”

Other examples of diseases that involve both humans and animals in Los Angeles County include flea-borne typhusleptospirosis, West Nile Virussalmonella, and rabies. In addition, wild birds in the County have tested positive for H5N1. There are currently no confirmed cases of H5N1 in humans in LA County.

Children, adults older than 65, pregnant people and people with weakened immune systems are at higher risk of serious illness from zoonotic diseases.

Public Health encourages people to follow these practices to prevent illness from pets and wild animals:

  1. Wash your hands. Always wash your hands with soap and clean, running water before preparing food and eating and after and outdoor activities or being around animals, even if you didn't touch the animals. If you don't have soap and water, use a hand sanitizer with at least 60% alcohol. Proper handwashing helps prevent the spread of germs.
  2. Be aware of zoonotic diseases: Be mindful of diseases that can be spread from animals to people, whether at home, petting zoos, animal exhibits, childcare settings, schools, or while traveling.
  3. Prevent insect bites. To avoid bites from mosquitoes, ticks, and fleas, use an Environmental Protection Agency (EPA)-registered insect repellent. Wear long sleeves, pants, and socks to cover your skin when hiking or walking outside. After being outdoors, check yourself, your clothes, and your pets for ticks and remove any you find right away. Keep grass short, remove leaf litter, and put tightly fitted screens on windows.
  4. Avoid animal bites and scratches. If you are bitten or scratched by an animal, seek medical care promptly, as these injuries can transmit diseases.
  5. Keep wildlife away. Don’t leave pet food and water bowls outdoors, especially overnight because this attracts wildlife. Pick up any fallen fruit and other possible food sources around your home. Raccoons and other wildlife may also be drawn to fishponds and bird feeders. Block access to basements, attics, and crawl spaces, and trim brush and trees away from your property and roof line. Close pet doors at night to prevent wild animals from entering your home.
  6. Handle food safely. Learn how to handle food properly for yourself, your family, and pets. Do not feed raw food to your pets.
  7. Remove animal waste. Use protective equipment to clean up and dispose of animal feces, including pet waste, from your yard or home daily. Animal feces can carry germs that may make humans and other animals sick.
  8. Do not touch dead wildlife. Dead wildlife can still spread germs harmful to people and other animals. Keep people and pets away from dead wildlife. Call your city or local animal control regarding dead animal removal.
  9. Cover sandboxes. Always cover sandboxes when not in use to prevent wild animals from pooping and urinating in them.
  10. Keep pets healthy. Work with your veterinarian to keep your pets healthy and free of diseases. Ask about preventative treatments for fleas, ticks, heartworm, and intestinal worms.

How to care for animals burned in a fire, wildfire, wildlife - Mary Cummins, Animal Advocates

When people find ill and injured animals their first instinct is to give it food and water. If an animal is extremely cold, hot, dehydrated, emaciated, ill or injured, this can quickly overload the animal’s system and cause it to die quickly. That’s why we wrote an article about how to care for extremely emaciated, dehydrated, ill and injured animals.

Here are some instructions if you find ill, injured, burned, singed animals in or around the fire area. Animals involved in fires have respiratory injuries due to the inhalation of air heated to a temps over 122F° which results in burns of the mouth, oropharynx and upper airway. The main cause of death on these patients is smoke inhalation associated to the fall of oxygen concentration due to carbon monoxide and dioxide during combustion.

Safely get the animal into a pet crate, container. Your safety and the safety of the animal are important. If possible, do not touch the animal. Lure the animal into a pet crate with a tiny piece of food. You can also corral the animal into the crate. If you cannot safely get the animal into a crate, stop and call a wildlife rehabilitator or animal control.

Cover the crate with a towel and place in a quiet place away from other animals or humans. Contact a wildlife rehabilitator or animal control. Do not give food or water at this time unless instructed by a wildlife rehabilitator or veterinarian. If you can't find a wildlife rehabilitator or veterinarian, follow instructions in the article linked above and the one below.

UPDATE: 12/13/2018 Defendant Ezra James pleaded nolo contendere to one count of cruelty to animals felony level 3 penal code 828..12.(2). Adjudication of guilt was withheld. Ezra is now a qualified offender and must give DNA. He was also fingerprinted. He's under supervised probation for 18 months. He must pay $609.92 in fees. He's been declared indigent. You can light a live raccoon in a trap on fire and let it suffer and just get a slap on the wrist. Shameful.

10/11/2018 Case continued at request of defendant. Early resolution scheduled for Dec 13, 2018 at 8:30 am before Judge Rhonda Babb Div 10 at Moore Justice Center.

There will be early resolution. Sounds like he's making a plea deal. I believe he will appear Oct 11 2018 to accept a plea deal. I have no idea what the plea is. I think he will plead guilty to a lesser offense and pay a fine and court costs. They may also sentence him to three years in jail with all time waived if he doesn't commit another crime while on probation for same time. That's just my guess.

The probably cause document has just been unsealed. It's below redacted as a two page pdf. Ezra is listed as retired. It states as follows,

"On August 16, 2018 Ezra Lee James did commit the offense of Animal Cruelty resulting in death by intentionally and willfully capturing a raccoon, pouring gasoline on it and setting it on fire while still in a metal trap. This resulted in the cruel death of the raccoon; when I arrived on scene the raccoon had been pulled out of the cage and was laying on the ground. The raccoon was still alive, completely burned, skin was pulled back from the feet from the burns. I had to put the animal down with my gun to end its suffering."

ORIGINAL: Ezra James trapped a raccoon which he believed was eating his mangoes. He admitted to then pouring gasoline on it lighting it on fire August 15, 2018 at night. He left the raccoon in the trap. The neighbor saw it and called police. Police humanely shot the raccoon to death to put it out of its misery. He was arrested at his home August 16, 2018. He paid bond and was bailed August 17, 2018. James, Ezra booking number 4857028.

Ezra Lee James was born February 12, 1930 in Jamaica. He currently lives in Palm Bay, Brevard County, Florida. He was arrested August 17, 2018 at his home. He was charged with a felony, cruelty to animals in the third degree. There are many other cases against him in Brevard County.

Ezra James was charged with a felony animal cruelty in the third degree. Sentence is no more than five years in jail and/or $10,000 fine. I personally believe Ezra James has some senility and has seriously lost his judgment. He admitted to his crime on video for the media. I think he should be sentenced to counseling, community service, a fine and probation. Jail time for an 88 year old man makes no sense.

In 2006 Ezra James went bankrupt. At the time he owned three homes and three cars which included a Cadillac Fleetwood, Lincoln Towncar and a 15 passenger Ford 350 bus. All homes were in foreclosure. He is listed as a transportation provider for the Port Authority of Florida. In 2006 he was a taxi cab service for E & J Transportation making $771/month and unmarried. He collected social security in the amount of $600/month. His bus was repossessed. He tried to get it back. His creditors fought the stays and discharges. His debts were discharged in 2007.

It's illegal to drown raccoons, opossums in Florida - Animal Advocates

July 2, 2018 There was a set conibear trap under the chicken pen. Conibear traps snap onto the head or leg of an animal. Most animals will chew off that leg to get out of the trap. That's why these traps are illegal in most areas.

"New information: Law enforcement discovered an illegal steel trap set under a chicken pen at the Ocala school where a teacher had horrifically drowned three animals. The teacher, Dewie Brewton, admitted knowledge of this trap.

Yes, this illegal “conibear” trap was included in the report that went to state attorney, Brad King, along with irrefutable evidence of aggravated cruelty. Still, NO CHARGES were filed in this case. We will not tolerate deliberate cruelty to animals and blatant disregard for Florida’s laws."

May 14, 2018  Florida teacher Dewie Brewton drowned an adult raccoon, a juvenile raccoon and an opossum. He has just resigned.

People are asking if it’s illegal to drown raccoons and opossums. It’s illegal to drown nuisance wildlife in Florida. Below is the statute from the Florida Fish & Wildlife Conservation Commission. http://myfwc.com/ .

68A-9.010 “Taking Nuisance Wildlife. (c) Euthanasia of nuisance wildlife shall be humane as defined by the American Association of Zoo Veterinarians or the American Veterinary Medical Association.”

Drowning raccoons and opossums would be considered animal cruelty in Florida. Title XLVI Crimes, Chapter 828, “Animal Cruelty.”

828.12 (1)  “A person who unnecessarily overloads, overdrives, torments, deprives of necessary sustenance or shelter, or unnecessarily mutilates, or kills any animal, or causes the same to be done, or carries in or upon any vehicle, or otherwise, any animal in a cruel or inhumane manner, commits animal cruelty, a misdemeanor of the first degree, punishable as provided in s. 775.082 or by a fine of not more than $5,000, or both.

(2) A person who intentionally commits an act to any animal, or a person who owns or has the custody or control of any animal and fails to act, which results in the cruel death, or excessive or repeated infliction of unnecessary pain or suffering, or causes the same to be done, commits aggravated animal cruelty, a felony of the third degree, punishable as provided in s. 775.082 or by a fine of not more than $10,000, or both.

(a) A person convicted of a violation of this subsection, where the finder of fact determines that the violation includes the knowing and intentional torture or torment of an animal that injures, mutilates, or kills the animal, shall be ordered to pay a minimum mandatory fine of $2,500 and undergo psychological counseling or complete an anger management treatment program.

(b) A person convicted of a second or subsequent violation of this subsection shall be required to pay a minimum mandatory fine of $5,000 and serve a minimum mandatory period of incarceration of 6 months. In addition, the person shall be released only upon expiration of sentence, is not eligible for parole, control release, or any form of early release, and must serve 100 percent of the court-imposed sentence. Any plea of nolo contendere shall be considered a conviction for purposes of this subsection.

(3) A person who commits multiple acts of animal cruelty or aggravated animal cruelty against an animal may be charged with a separate offense for each such act. A person who commits animal cruelty or aggravated animal cruelty against more than one animal may be charged with a separate offense for each animal such cruelty was committed upon.

We feel that Dewie Brewton committed three acts of intentional aggravated animal cruelty in the third degree. If convicted, the sentence would be six months jail time per act, $10,000 fine per act, psychological counseling and completion of an anger management program. We wrote a letter to the state attorney Brad King who oversees Marion county, Florida where this happened asking for charges to be made. We cc'd the letter to the Fish & Wildlife Commission, the school and the school district.

Baby allegedly attacked by raccoon may have been bitten by rats - Animal Advocates

Allegedly around 11:00 p.m. mother Ashley Rodgers at 2141 North 22nd, Philadelphia, PA left her 4-month-old baby Journi Black alone in a one room apartment for one minute while taking another child to the bathroom a foot away. The baby's father Samuel Black was not present. During that one minute allegedly a raccoon entered the home, bit the baby then left the home. Mother found the baby on the floor. Baby was rushed to Temple and  then to St. Christopher for surgery. Now mother is raising money on gofundme and she wants to sue building owner. This is very suspicious.

We've rehabbed raccoons and rats for many years. These appear to be bite marks from a rat. They are not bite or claw marks from a raccoon. Raccoon bite marks leave a dental impression. A raccoon could have bitten the nose, ears, lips off. Claw marks would be five long deep marks. This was clearly a rat or rats.

I personally believe the mother had been out with some friends. She came home at 11:00 p.m. maybe even later and found her baby with rat bites on her face. Maybe the baby wasn't even bitten at the building but another building. Then she made up the story about a raccoon. It's a one room apartment she rented for $375/mo. True, there shouldn't be rats in the room but she had to have left the baby alone which is against the law. That baby would have been screaming. It would take a rat a while to bite, eat that much of the baby's face.

This research article is about rat bites on humans. It generally happens with babies, disabled or elderly left alone and unsupervised. Rats leave "multiple 3-4 mm long sharply demarcated, slightly curved incisions on face, ears."

Pesticides cause baby squirrels, opossums, raccoons to be born with no eyeballs - Mary Cummins, Animal Advocates

We've been getting in orphaned squirrels, opossums with missing eyes for quite a few years. The tree squirrels end up with no eyeballs due to pesticide spraying of their nest while the mother is pregnant. The opossums end up with no eyeballs due to mother ingesting snails poisoned with Snarol.

Recently we've been getting in orphaned raccoons missing eyeballs. If they are missing both eyes, they won't survive and must be euthanized. Same with tree squirrels as per the California Department of Fish & Wildlife. We used to keep them in our sanctuary if they were happy. Generally orphans that are born disabled are fine with their disability as it's all they ever knew.

Because the babies are deformed the mothers dump them out of the nest, den to die. Mom can't waste her milk on a baby which will not be able to survive. Sad situation. This of course means more orphans for us to care for.

If the animals has one eye, he can be rehabbed and released. Missing both eyes we now must euthanize as per Fish & Wildlife. Please, help us rescue and release the babies that we can. Thanks.

Just when I think I've seen it all, raccoons being sold as food in Los Angeles - Animal Advocates

UPDATE: 02/14/2015: Supposedly the raccoons came from a wholesaler in Florida. More than one market was selling the raccoons. One market sold it for $22/lb. Investigation is ongoing.

Metro Supermarket located at 4819 Temple City Boulevard, Temple City, CA 91780 (626) 872-6955 is selling dead raccoons in a bag for $54 or $9.99/pound. They have been selling it for years they state. Authorities trying to figure out if it's legal. It might be legal if the source is legal. From a common sense point of view raccoon is the last meat you should eat. Every raccoon we've taken into rescue has had round worms which can be fatal to humans. You can't destroy it by just cooking it. They are also a Rabies Vector Species. This means they are more likely to have rabies though not all have rabies. Our main rabies vector animal here in LA is bats.

Supposedly raccoons are a "delicacy" in China which is odd as they are not native to Chine and have no raccoons there. I think some guy just told people it cures impotence or something to make money off gullible people. Turns out raccoon dogs which are not raccoons are native to Asia. They are called tanookis. Maybe they think they are raccoon dogs which we don't have here. Here is the original video from Christina Dow. In the video you see what looks like some large animals entire paw wrapped up. Raccoon meat is legal to sell if it's legally procured and presented. This company sells raccoon meat. The small size one is a juvie raccoon. They should have USDA stamps. I think they sell them whole as there is no butcher who wants to dress them, i.e. skin, gut, cut up...

Here is the bar code from the package 230500 754350. The "2" means it's meat that was weighed and wrapped in the store. The "5435" is the price. The "0" verifies the price. Still trying to figure out the "30500." That should be the type of meat.
